Regime for the processing of your data

We inform you that ABANCA will communicate the necessary data for the car insurance contracting process to the insurer ABANCA Generales de Seguros y Reaseguros, S.A. (“ABANCA Seguros Generales”) and to the intermediary ABANCA Mediación Operador de Banca-Seguros Vinculado, S.L. (“ABANCA Mediación”). The necessary data will be as follows:

  • Name, surname, date of birth, and gender.
  • DNI or NIE.
  • How to contact you (postal address, landline and/or mobile phone, and email address).
  • Nationality and place of birth.
  • If applicable, your status as an employee of the ABANCA Group.

The insurer ABANCA Seguros Generales and the intermediary ABANCA Mediación will process your indicated data, as independent data controllers, for the following purposes:

  1. The insurer may make the corresponding offer and process the insurance contract, which will also include the analysis of the information you provide to us in the future, as well as consultation of the following sources:
  • Consultation of data in common insurance sector files. As it is necessary for the processing of the insurance contract, ABANCA Seguros Generales may consult files such as:

    • The historical car insurance file (SINCO).
    • And risk selection and rating files (which are databases commonly used in the insurance sector to verify the characteristics and history of the vehicle, assess the risk to be insured, and adjust the rate).
  • And, based on the legitimate interest of the insurer, consultation of the common credit information file ASNEF, in order to obtain information about your solvency and credit and to complete the risk selection rules.

  1. The intermediary may manage, in case you wish to use the chat service or the telephone support service, any operational questions, queries, or incidents that may arise during the contracting process. Also, so that the intermediary can make and provide you, for the purposes of the current insurance distribution regulations, with a personalized recommendation to offer you the specific product that, based on the information you subsequently provide during the insurance contracting process, will best meet your requirements and needs.

In addition, if you provide identifying and contact data of other insured persons, you guarantee that you have obtained the explicit consent of said insured persons for the communication of their personal data to the insurer for the purpose of processing the insurance contract.

The data will be retained during the insurance contracting process and, if you finally contract it, will also be retained during the validity of the insurance. Once your pre-contractual or contractual relationships with the intermediary and the insurer have ended, and unless you have given your consent for the retention of your data once these relationships have ended, the data will be blocked for the limitation periods established by the applicable current regulations. Once these periods have elapsed, the data will be deleted.

Additionally, we inform you that data protection regulations grant you a series of rights in relation to the processing of your personal data:

  • Right of access. You can find out what type of data we are processing and the characteristics of the processing we are carrying out.
  • Right of rectification. You can request the modification of your data when it is inaccurate or incomplete.
  • Right to data portability. You can obtain a copy in an interoperable format of the data being processed.
  • Right to restriction of processing. You can request the restriction of the processing of your personal data when any of the conditions set out in the law are met.
  • Right to erasure. You can request the deletion of your data when the processing is no longer necessary.
  • Right to object. You can request that we do not process your data for decision-making based solely on automated processing. Likewise, you can request the cessation of processing based on legitimate interest, in which case we will stop processing your data unless we demonstrate compelling legitimate grounds for the processing that override your rights, or for the establishment, exercise, or defense of legal claims.
  • Right to withdraw consent given at any time.

  • Name, surname, date of birth, and gender.
  • ID number (DNI).
  • How to contact you (postal address, landline and/or mobile phone, and email address).
  • Nationality and place of birth.

ABANCA Seguros Generales (the insurer) and ABANCA Mediación (the intermediary) will process your indicated data, as autonomous data controllers, for the following purposes:

  1. The insurer may make the corresponding offer and process the insurance contract, which will also include the analysis of the information you provide to us in the future, as well as, based on the legitimate interest of the insurer, consulting the common credit information file ASNEF, in order to obtain information about your solvency and credit and to complete the risk selection rules.
  2. The intermediary may manage, in case you wish to use the chat service or the telephone support service, any operational questions, queries, or incidents that may arise during the contracting process. Also, so that the intermediary can make and provide you, for the purposes set out in the current insurance distribution regulations, with a personalized recommendation to offer you the specific product that, based on the information you subsequently provide during the insurance contracting process, will best meet your requirements and needs.

Furthermore, when you provide us with health data requested through the corresponding questionnaire, you consent to such data being processed by the insurer to manage the insurance contracting process.

Likewise, if you provide identifying and contact details of other insured persons, as well as their health data, you guarantee that you have obtained the explicit consent of those insured persons for the communication of their personal data, including health data, to the insurer for the purpose of processing the insurance contract.

The data will be kept during the insurance contracting process and, if you finally contract the insurance, will also be kept for the duration of the insurance. Once your pre-contractual or contractual relationships with the intermediary and the insurer end, and unless you have given your consent for your data to be kept after these relationships end, the data will be blocked for the limitation periods established by the applicable regulations. Once these periods have elapsed, the data will be deleted.

Additionally, we inform you that data protection regulations grant you a series of rights regarding the processing of your personal data:

We inform you that ABANCA will communicate the necessary data for the home insurance contracting process to the insurer ABANCA Generales de Seguros y Reaseguros, S.A. (“ABANCA Seguros Generales”) and to the intermediary ABANCA Mediación Operador de Banca-Seguros Vinculado, S.L. (“ABANCA Mediación”). The necessary data will be as follows:

  • Name, surname, date of birth, and gender.
  • DNI, passport, or NIE.
  • How to contact you (postal address, landline and/or mobile phone, and email address).
  • Nationality and place of birth.
  • If applicable, your status as an employee of the ABANCA Group.
  • And, in the event that you wish to link the home insurance to a mortgage financing operation that you have formalized with ABANCA or for which you are in the process of contracting with ABANCA, we will communicate your request for linkage to the insurer (including the identifying data of said financing operation) as well as both the data of a patrimonial nature relating to the appraisal of the property subject to the mortgage guarantee, so that the insurer can apply its value established in the appraisal for insurance purposes, and the data of the address of said property and its ownership (your status as owner of the same).

The insurer ABANCA Seguros Generales and the intermediary ABANCA Mediación will process your indicated data, as independent data controllers, for the following purposes:

  1. So that the insurer can make the corresponding offer and process the insurance contract, which will also include the analysis of the information you provide us in the future, as well as, based on the legitimate interest of the insurer in the proper formalization of the contract, the consultation of the following data available in public sources and registers, which will be provided to the insurer through an information service provider (AXESOR): characteristics relating to the property, public census data, or sociodemographic profiles of the area. In addition, if you have given or give your consent for profiling with external sources, ABANCA Seguros Generales may consult the sociodemographic characteristics linked to the location of the property obtained through geo-statistical indicators calculated based on generic anonymized and/or aggregated information by geographic area, characteristics which by themselves do not entail the creation of individualized profiles, but will help us complete the information we have about you and thus offer you a premium more adjusted to the risk or your profile, as well as other products also suitable for your profile.

  2. So that the intermediary can manage, in the event that you wish to use the chat service or the telephone support service, any operational questions, queries, or incidents that may arise during the contracting process. And also so that the intermediary can make and provide you, for the purposes of the current regulations on insurance distribution, with a personalized recommendation to offer you the specific product that, based on the information you subsequently provide us during the insurance contracting process, will best meet your requirements and needs.
