Promotion Terms and Conditions

This promotion, organized by ABANCA Corporación Bancaria S.A. (hereinafter, “ABANCA”), will be governed by the following terms and conditions, which have been deposited with the notary Mr. Francisco Ordóñez Armán, of the Illustrious Notarial College of A Coruña, on December 18, 2015, under protocol number 1,904/2015.

First. Territorial and Temporal Scope

The use of the Proyecta card (hereinafter, “card”) entitles the holder to a refund of 1% of the total amount of purchases made with the card during the period and under the conditions established in these terms and conditions, up to the limit indicated in Clause Three.

The following transactions are expressly excluded:

• Transactions that have been declined, regardless of the reason for the decline, as well as canceled transactions and test transactions.
• Transactions considered fraudulent.
• Returns, cancellations, and early repayments made with the card. If any of these transactions occur, the amount to be refunded will be reduced by the same percentage indicated above.
• Cash withdrawals at ATMs/branches.

Second. How long does the promotion last?

The promotion will begin on July 20, 2015 and will end on 31 de diciembre de 2026, both dates inclusive (hereinafter, “promotional period”).

Third. Discount

A 1% discount will be applied to purchases validly made with the card, with a maximum limit of 1% of the card’s credit limit.

The corresponding credit will be made to the card’s credit account with which the purchases were made. This credit will take place in the same month in which the transactions that entitled the holder to the discount were made.

Fourth. General Considerations

Participation in the promotion implies full acceptance of these terms and conditions; therefore, any statement of non-acceptance will result in the exclusion of the participant, and as a consequence, ABANCA will be released from fulfilling any obligation to that participant in relation to this promotion.

Acceptance of the prize by the participant entails definitive acceptance of these terms and conditions.

ABANCA reserves the right to modify the conditions of this promotion at any time, including its possible cancellation before the closing date, provided there is justified cause, and undertakes to communicate in advance the new terms, conditions, or, if applicable, the definitive cancellation in the same manner and medium as these terms and conditions.

It is an essential condition to be eligible for the prize that the participant is up to date with their payments throughout the promotion, and that the card is not blocked, expired, or cancelled during the promotional period.

In the event of fraud or any promotional mechanism that does not comply with these rules or good faith, ABANCA reserves the right not to grant this promotion.

The promotion will apply to cards that meet the requirements set out in these Terms and Conditions, regardless of whether the payment is associated with an account opened at ABANCA or at another financial institution.

This Promotion cannot be combined with other discounts or promotions that ABANCA may offer in relation to the card; in such case, the most beneficial for the participant will apply.

Fifth. Tax Regime

In accordance with current tax regulations, the crediting of the aforementioned amounts by ABANCA is considered a capital gain subject to the personal income tax (IRPF) of the recipient.

Sixth. Deposit of the Terms and Conditions

These terms and conditions are available to all participants at any ABANCA branch and on this page.

Seventh. Jurisdiction

For the resolution of any dispute that may arise regarding the interpretation or application of these terms and conditions, the parties expressly submit to the jurisdiction and competence provided for in the applicable legal regulations.
