1. Who is responsible for processing your personal data?

The entity responsible for processing your personal data is ABANCA Corporación Bancaria, S.A. (hereinafter, "ABANCA" or the "Entity"), with NIF A70302039 and registered office in Betanzos (A Coruña), at Calle Cantón Claudino Pita nº 2, C.P. 15300.

At ABANCA, we have a formally appointed Data Protection Officer, whom you may contact in writing, if needed, to obtain more information about any of the points included in this Privacy Policy and to send your questions, inquiries, or complaints related to the processing of your personal data, via the following email address: privacidad@abanca.com.

2. What is the source of your personal data and what data do we process?

ABANCA will process the data you provide directly by filling out and submitting the web form found on the site colabora.abanca.com, as well as any data that may be generated in connection with its management. Likewise, ABANCA may process your financial personal data that it holds due to contractual and/or pre-contractual relationships that you may have established or may establish with ABANCA (e.g., the account number to which your donation amount will be charged).

The personal data we request through the web form referred to in the previous paragraph are strictly necessary to fulfill the purposes indicated in section 3 ("For what purpose and on what legal basis do we process your personal data?") of this Privacy Policy and belong to the following categories:

(i) Identification data: name, surname, and DNI/NIF; and

(ii) Contact data: phone number, postal address, and email address; and

(iii) Financial data: account number (IBAN) for managing the donation charge—exclusively in the case that you choose this payment method to make the donation.

In no case are you obliged to provide such data, but please note that if you do not, it will be impossible to process the donation request you wish to submit through the web form. Likewise, we remind you that the data you provide must be true, accurate, and up-to-date for the purposes for which they are requested.

3. For what purpose and on what legal basis do we process your personal data?

The processing of your personal data referred to in section 2 ("What is the source of your personal data and what data do we process?") of this Privacy Policy will be used exclusively for the following purposes:

(i) To process the donation request you make by filling out and submitting the web form on the site colabora.abanca.com, including the management of any incidents that may arise in connection with such processing. The legal basis legitimizing the processing referred to in this section (i) is the execution of the request you make as a donor by completing and submitting the web form on the site dibujarsonrisas.abanca.com;

(ii) To manage the issuance of the corresponding tax certificate for the donation made; this certificate will be issued and sent directly to donors by the beneficiary entity of your donation, which is the Fundación UNICEF Comité Español (hereinafter, “UNICEF Spain”)—registered in the State Competence Foundations Registry with registration number 759—with registered office in Madrid, at Calle Mauricio Legendre 36, CP 28046, and CIF G84451087, in accordance with section 4 ("Who do we share your personal data with?") of this Privacy Policy.

The legal basis legitimizing the processing referred to in this section (ii) is the execution of the request you make as a donor by completing and submitting the web form on the site dibujarsonrisas.abanca.com; and

(iii) If you are an ABANCA Client, to send you communications by any electronic or non-electronic means related to the "Dibujando sonrisas 2025 Campaign" promoted by the Entity. For this purpose, please note that you may object, free of charge and at any time, to receiving this type of communication. To do so, you may send us a message to the following email address: bajas@abanca.com.

The legal basis legitimizing the processing referred to in this section (iii) is the mutual legitimate interest in keeping you informed about the progress and status of the “Dibujando sonrisas 2025 Campaign.”

4. Who do we share your personal data with?

For the sole purposes of managing the payment of the donation amount and processing the issuance and delivery of the corresponding tax certificate for your donation, ABANCA will communicate the personal data you provide through the form on the site colabora.abanca.com, as indicated in section 2 ("What is the source of your personal data and what data do we process?") of this Privacy Policy, to the beneficiary entity of your donation, which is UNICEF Spain, with registered office in Madrid, at Calle Mauricio Legendre 36, CP 28046, and CIF G84451087.

Additionally, we inform you that your personal data may also be communicated to the Tax Agency and other Public Administration bodies for the exercise of their legitimate powers under the terms established by current regulations, exclusively when such data communication is necessary and to the extent determined by applicable legislation at any given time.

Apart from the above cases, your personal data will not be communicated to any third party, unless there is a legal obligation applicable to ABANCA.

5. Is any international transfer of your personal data planned?

We inform you that no international transfer of your personal data is planned to achieve the purposes indicated in section 3 ("For what purpose and on what legal basis do we process your personal data?") of this Privacy Policy.

6. How long do we keep your personal data?

The personal data obtained by filling out and submitting the form on the site colabora.abanca.com, as well as any data that may be generated in connection with it, will be kept for the time necessary to fulfill the purposes indicated in section 3 ("For what purpose and on what legal basis do we process your personal data?") of this Privacy Policy.

Once these purposes have been fulfilled, the data will be blocked in accordance with the regulations, which means they will only be available for the formulation, exercise, or defense of claims or at the request of Judges and Courts, the Public Prosecutor's Office, or the competent Public Administrations during the legal limitation periods (generally, five years, which is the limitation period for personal actions). After these periods, the personal data will be deleted.

7. What are your rights?

Data protection regulations grant you a series of rights regarding the processing of your personal data:

  • Right of access. You can find out what type of data we are processing and the characteristics of the processing we are carrying out.

  • Right of rectification. You can request the modification of your data when they are inaccurate or incomplete.

  • Right to data portability. You can obtain a copy in an interoperable format of the data being processed.

  • Right to restriction of processing. You can request the restriction of the processing of your personal data when any of the conditions set out in the Law are met:

    • When you challenge the accuracy of your personal data, during the period in which ABANCA verifies their accuracy;

    • When the processing is unlawful and you oppose the erasure of your personal data and request, instead, the restriction of their use;

    • When ABANCA does not need to process your personal data but you need them for the establishment, exercise, or defense of claims; and

    • When you have objected to the processing of your personal data for the performance of a task carried out in the public interest or for the satisfaction of a legitimate interest while it is being verified whether the legitimate grounds for the processing override yours.

  • Right to erasure. You can request the deletion of your data when processing is no longer necessary.

  • Right to object. You can request that we do not process your personal data and not be subject to decisions based solely on automated processing. Likewise, you can request the cessation of processing based on ABANCA's legitimate interest, in which case we will stop processing your data unless we demonstrate compelling legitimate grounds for the processing that override your rights, or for the establishment, exercise, or defense of claims.

  • Right to lodge a complaint with the supervisory authority (in Spain, the Spanish Data Protection Agency https://www.aepd.esYou will be redirected to another website), if you consider that your rights have been violated.

You may exercise the aforementioned rights by writing to ABANCA's Customer Service at the postal address: Rúa Nueva, 1 - Entreplanta, C.P. 15003, A Coruña or by email: atencioncliente@abanca.com. In any case, you must properly identify yourself, indicate the reference "Data Protection - Dibujar sonrisas 2025 Campaign" and the specific right you wish to exercise.

We will process your request as soon as possible and, in any case, within the legal period of one (1) month from receipt of your request. This period may be extended by another two (2) months if necessary, taking into account the complexity and number of requests received. In this case, you will be informed of the extension within the first month from receipt of the request, indicating the reasons for the delay.
