Measures to Alleviate Mortgage Burden (Code of Good Practices)

The rise in interest rates, together with the recent increase in the cost of other basic goods and services, has had a significant impact on the financial situation of families with variable-rate mortgages.

This situation has led to the urgent need to adopt a set of measures to strengthen the protection of mortgage debtors at risk of vulnerability, allowing for relief from their financial burden.

For this reason, Royal Decree-Law 19/2022 of November 22You will be redirected to another website was published in the BOE of November 23You will be redirected to another website, establishing a Code of Good Practices to alleviate the rise in interest rates on mortgage loans for primary residences (NCBP 2022), amending Royal Decree-Law 6/2012You will be redirected to another website of March 9, on urgent measures to protect mortgage debtors without resources (CBP 2012), and adopting other structural measures to improve the mortgage loan market.

The NCBP 2022, of a transitional nature (until December 31, 2025*), was created to alleviate the financial burden of mortgage debtors at risk of vulnerability due to rising interest rates. Those borrowers who meet the eligibility requirements (income level, increased mortgage effort, mortgage payment, etc.) established in the Council of Ministers Agreement of November 23, 2022You will be redirected to another website published in the BOE of November 24 (amended by the Resolution of December 27, 2023, of the Secretary of State for Economy and Business Support, which publishes the Council of Ministers Agreement of December 27, 2023, for the amendment of the Code of Good Practices of urgent measures for mortgage debtors at risk of vulnerability) may benefit from it.

The aforementioned Royal Decree-Law also extends the already existing CBP 2012 for the restructuring of mortgage debt for debtors without resources, so that it covers vulnerable debtors affected by interest rate increases that result in excessive mortgage effort levels due to any increase in mortgage effort.

ABANCA is currently adhered to these measures, which are set out as Good Practices.
