General Terms and Conditions of the Bizum Instant Transfer Service
Purpose and Definitions.
These general conditions govern the terms under which ABANCA (hereinafter, the "User(s)") will provide, upon request, the Immediate Transfers and Payments in Stores Service (hereinafter, "the Service"). The Service consists of enabling the User, through the ABANCA App, to send and receive funds to and from other Users instantly using the recipient’s mobile phone number as identification, as well as to make payments in stores both in person and remotely, in the manner and terms defined in these conditions. Only payment orders denominated in euros will be accepted. For the purposes of these general conditions, a User is understood to be a natural person acting for purposes unrelated to their commercial, business, trade, or professional activity. When the User initiates the payment, they are referred to as the Payer, and when they receive the payment, as the Beneficiary.
The Service is provided by ABANCA Corporación Bancaria, S.A.
Unique Identifier and Associated Account.
Once the User has correctly identified themselves in the App, they must provide certain data: the account to be used, which will receive funds sent by other Service users and from which all payment transactions will be debited, and the unique identifier that allows Users to be identified as beneficiaries (mobile phone number), which will be linked to the account. The User may modify the data and associated account at any time, as well as unsubscribe from the Service in the manner established by ABANCA. The subsequent cancellation of the associated account, for any reason, will be sufficient grounds to terminate this contract. Blocking the associated account or any circumstance that limits the availability of its funds will result in the suspension of the Service.
Transactions.
3.1. C2C Service:
(i) The Payer may send funds to a Beneficiary ("Send BIZUM" mode) identified by their mobile phone number. Once a transaction request is registered, the amount will be debited from the Payer’s account associated with the Service (unless another account owned by the Payer is specified), plus, if applicable, the corresponding commission; (ii) The Beneficiary may also request payment from a third party ("Request BIZUM" mode). In such cases, the third party (the Payer) will receive a message on their mobile phone, requesting acceptance of the transfer proposal made by the Beneficiary. If the Payer accepts the proposal, a transfer will be executed from their associated account and the funds will be credited to the Beneficiary’s associated account. The funds will be credited immediately once the Payer has accepted.
3.2. EuroPA Functionality:
Allows immediate transfers between Bizum Service Users and individual users of similar services in other SEPA zone countries with which Bizum, S.L. has interoperability agreements. The User will operate in the same way, but must indicate the international phone prefix of the relevant country. The following are not available in the EuroPA functionality:
- (i) payments between Users (only available when the recipient is not also registered in the Bizum Service);
- (ii) inviting users in similar services in other countries (invitation message to recipient);
- (iii) portability;
- (iv) beneficiary-initiated payment mode;
- (v) requesting transfer refunds;
- (vi) ordering multiple payments;
- (vii) including additional content.
3.3. C2R Service:
Allows payment for goods and services in person at establishments that accept it and are equipped with terminals (POS) compatible with NFC, QR, or any other technology implemented.
3.4. C2eR Service:
Allows payment for goods and services purchased remotely on the websites of establishments equipped with payment applications that support this service mode.
3.5. Bizum Electronic Identification and Registration Service:
This service facilitates registration and login on remote merchant platforms that offer this option. When the User registers using this service at a remote merchant, Bizum will provide the merchant with the User’s personal data, avoiding the need for manual entry.
In addition to the operations indicated above, and in accordance with the Regulations of the Immediate Transfers Service and complementary Regulatory Framework, the Entity allows the User, through the Service, to perform the following queries and operations:
- Access the contact list to initiate payment from the mobile phone.
- Profile management: the User may modify the account associated with the Service, provided the new account is held at ABANCA, and the unique identifier. In these cases, any "Request BIZUM" transactions in progress will be cancelled.
The Service is available every day of the year, 24 hours a day.
The conditions and procedures set out in this clause will apply solely and exclusively to the extent that the described operations are effectively implemented and available to the User.
Sending Funds to Third Parties Who Are Not Users.
Funds may be sent through the Service to a third party, a natural person, who is not a User at the time the payment order is given, provided they have a mobile phone with a Spanish prefix. In this case, an SMS will be sent to the third party’s mobile phone, informing them of your intention to transfer a specific amount and inviting them to access their bank’s mobile banking to register in the system. If the Beneficiary accepts the invitation and registers within 48 hours, the transfer will be executed, unless the Payer cancels the transaction beforehand.
Service Limits.
The following limits are established for the Service, and any transactions that exceed these limits will be automatically rejected:
For mobile-to-mobile money transfers
- Maximum amount per transaction: €500.
- Minimum amount per transaction: €0.50.
- Maximum amount received per user per day: €2,000.
- Maximum amount sent per user per day: €500.
- Maximum number of transactions received per user per month: 60 transactions.
- Maximum number of payment requests made per user per month: 60 transactions.
- Maximum amount sent per user per month*: €1,000.
For online store purchases:
- Maximum amount per transaction: €1,500.
- Minimum amount per transaction: €0.01.
- Maximum daily amount: €2,500.
- Maximum monthly amount*: €9,000.
For in-store purchases:
- Maximum amount per transaction: €3,000.
- Minimum amount per transaction: €0.01.
- Maximum daily amount: €3,000.
For donations:
- Maximum amount per transaction: €500.
- Minimum amount per transaction: €0.50.
- Maximum amount sent per user per day: €1,000.
- Maximum amount sent per user per month*: €1,000.
For betting payments and prize collections at state lottery and betting offices:
- Maximum payment per transaction: €500.
- Maximum payment per user per day: €1,000.
- Maximum payment per user per month*: €1,000.
- Maximum amount for collection: €2,000.
*For monthly calculations, the limit starts counting from the 1st day of each month.
These maximum and minimum limits are set directly by Bizum, S.L., and may be reviewed and modified, of which ABANCA will duly inform the User via e-correspondence and on the abanca.com website, where they will be permanently updated. Notwithstanding the above, ABANCA may modify them within the maximum and minimum limits set by Bizum, S.L., informing Users via e-correspondence.
Receipt of Payment Orders.
Payment orders initiated by the User will be deemed received by ABANCA at the moment the User completes the form and consents to the transfer. Once received, payment orders are irrevocable. Consequently, the refund of funds, once credited to the Beneficiary’s account, will only be possible with the Beneficiary’s consent.
Information on Execution of C2C Transactions.
In both transaction modes ("Send BIZUM" and "Request BIZUM"), ABANCA will confirm the result of the transfer to the User.
User Responsibility.
The User is responsible for the accuracy and up-to-date status of their identification data at all times, as well as for the data used to identify their payment or collection contacts. The User is also responsible for the correct use of the Service and for any consequences arising from improper use of its features.
The User also accepts the irrevocability of ordered payments, once the amount has been credited to the third party, and consents to the reversal of credits to their account when payments have been made in error or if the Beneficiary of the transaction has returned them within the legally established timeframes and manner.
ABANCA Responsibility.
ABANCA will be responsible for the correct execution of orders placed by the User, provided they are not fraudulent or illegal transactions carried out by the User or by any person accessing the Service without the User’s authorization, unless such access was directly attributable to ABANCA. However, if ABANCA becomes aware of fraudulent transactions, it will immediately inform the User.
Likewise, if ABANCA executes the payment order incorrectly, for example, by using a mobile phone number to identify the Beneficiary other than the one indicated by the Payer, it must restore the account to the state it was in before the order was executed.
Early Termination.
The Service will be terminated early if ABANCA loses its status as a BIZUM member entity. In addition, ABANCA may terminate the Service due to non-use for a continuous period of 6 months, after prior notice to the User, due to the subsequent cancellation of the associated account without providing a replacement, or due to the User’s breach of any of the obligations set out in these general conditions.
Portability from Another BIZUM Member Entity.
If the User wishes to register for the Service through another BIZUM member entity using the same mobile phone and personal identifier (NIF or similar), they may do so by submitting a portability request to the new entity, which will then contact ABANCA on the User’s behalf, and the User will be deregistered from the Service at ABANCA.
Registration with the new entity will result in the cancellation of any pending "Request BIZUM" transactions with the Entity.
Similarly, the User may request portability to ABANCA if they are registered with another BIZUM member entity.
Miscellaneous.
12.1. Duration. The contract is of indefinite duration, so either party may terminate it at any time, without the need for justification. If the Entity exercises this right, it must notify the User of the termination with two months’ notice, unless the termination is due to the User’s breach of the Service conditions, in which case this period does not apply.
12.2. Modifications. The Entity may modify these conditions, after prior notice to the User. If the User does not agree with the proposed modification, they may unsubscribe at no additional cost. The User will be deemed to accept the new conditions if they do not expressly and in writing state their disagreement or if they continue to use the Service.
12.3. Language. These general conditions and communications sent to the User will be drafted in Spanish or in any of the other official Spanish languages of the respective Autonomous Communities where the Service is provided.
12.4. Applicable Law and Jurisdiction. These conditions will be governed by Spanish law, and the parties submit to the competent Courts and Tribunals in accordance with applicable legislation for the exercise of any actions and claims that may correspond to them.
12.5. Withdrawal. The User has 14 calendar days from the day after the contract is formalized to withdraw from it, without the need to indicate a reason, by requesting cancellation on the website or through Remote Banking.
Bizum Contracting by Minors.
Where operationally possible, minors under 18 but over 12 years of age may contract the Bizum service through their legal representatives, with the following particularities:
The permitted operations are: sending money, receiving money, and making purchases and payments in person or online.
The legal representative may choose, both at registration and at any later time, to apply limits to the operations indicated in the preceding paragraph.
Specific Conditions for Enrolling ABANCA Cards in Bizum Pay.
14.1. Purpose and Operation of the Service
This clause governs the conditions for enrolling and using ABANCA-issued debit, prepaid, and credit cards in the digital wallet application (hereinafter, "Bizum Pay") installed on compatible devices (Smartphone, Smartwatch, etc.).
The service allows the device holder (hereinafter, the "Holder") to make in-person payments (via NFC technology) without presenting the physical card, using instead a digital token stored on the device.
14.2. Link to the Card Framework Contract
- No Novation: Card enrollment does not imply the issuance of a new card nor does it modify the main card contract signed with ABANCA.
- Prevalence: In the event of a technical discrepancy regarding mobile payment use, these Terms and Conditions shall prevail. For all other matters (credit limits, usage limits, fees, interest), the card contract shall apply.
14.3. Enrollment and Verification Process
To enable the service, the Holder must:
- Enter the card details manually, by image capture, or via contactless communication (NFC).
- Pass the Strong Customer Authentication (SCA) protocols required by the Entity.
- ABANCA reserves the right to deny enrollment for security reasons or if the card is not operational.
14.4. Authorization of Transactions and Biometrics
- Consent: Payment will be considered authorized when the Holder validates the transaction on their device using biometric factors (fingerprint, facial recognition) or the device unlock code.
- Irrevocability: Once the transaction is validated by these means, the payment order is irrevocable in accordance with current regulations.
14.5. Custody and Security Obligations
The Holder assumes the following specific obligations:
- Safeguard the mobile device with the same diligence as a physical card.
- Keep the device locked with robust security measures.
- Do not share unlock codes or allow third-party biometric registration.
- Update the device’s operating system to ensure security patches are applied.
14.6. Loss, Theft, and Emergency Measures
In case of loss, theft, or unauthorized use of the device, the Holder must:
- Immediately notify ABANCA via the phone number indicated in the card contract to proceed with blocking the token.
- Notifying the device manufacturer or mobile operator does not replace the obligation to inform ABANCA.
- ABANCA may block the service if it detects signs of fraud or risk of non-payment.
Data Protection.
Who is responsible for processing your data?
ABANCA Corporación Bancaria, S.A. ("ABANCA"), with CIF A-70302039, is responsible. At ABANCA, we have a Data Protection Officer, whom you can contact at privacidad@abanca.com.
Where do your personal data come from and what data do we process?
A. For the registration and operation of the Service, we process the following data:
1. Service registration: To register you, we will process your identification, contact, and banking data. For example:
- Name and surname, mobile phone, and email address you provide us.
- The "Bizum alias": this is an alias created by Bizum to offer a secure user experience, and it consists of your name along with the initials of your surnames.
- Account number (IBAN) at ABANCA.
And, if you act as the legal representative of a minor, we will also process the data you provide us about the minor, as well as their "Bizum alias."
2. Use of the Service: We will process the following data generated when you use the Service:
- Financial information generated when you use the "Send Bizum" or "Request Bizum" functions, or when other users who interact with you use them (when those other users send you money or request a payment from you).
- Information about transactions you make in person through Bizum (C2R Service): when you pay for products or services in person at an establishment (using POS terminals compatible with NFC, QR, or any other technology), we will process the payment details (including your card data, when you use it) to manage the transaction.
- Information about transactions you make online through Bizum (C2eR Service): when you purchase products or services online, we will process the payment details to manage the transaction.
- Connection data, such as the IP address of your device, your location (geolocation, if you give us permission), or WIFI connections made.
- Identification and contact data of other users you provide us (your contacts). In this regard, we may also access your contact list on your device, if you give us permission.
- Information about the portability process, that is, if you decide to bring your Bizum to ABANCA from another bank or vice versa.
As a User, you are responsible for ensuring that the data you provide us are real and up to date. This also applies to the information you provide us about your contacts or about the minor you may represent.
B. For the registration and operation of the Bizum Pay application (App) (provided you have registered with Bizum through ABANCA), we will also process the following data:
- App registration and activation: We will check in our systems that you are already registered with Bizum, as this is mandatory to use the App.
- Authentication: Bizum, S.L. will inform us if you have authenticated to make a payment through the App.
- Your devices: We will process information about the devices (mobile phones, tablets, etc.) where you have activated or configured Bizum Pay. This information may be provided directly by Bizum, S.L.
- App deactivation: If you decide to unsubscribe, you can do so through Bizum Pay or ABANCA. In both cases, both entities will notify each other so that the App is properly deactivated.
Why do we process your personal data and on what legal basis?
1. Processing necessary for the execution of your contractual or pre-contractual relationships with ABANCA:
A. Registration and operation in Bizum and Bizum Pay. We will process your data to:
- Manage your registration in Bizum and also in Bizum Pay (if you request it).
- Identify you securely: when you register in Bizum Pay, the App will redirect you to your Mobile Banking so we can authenticate you. We will inform Bizum, S.L. if such authentication has been successfully completed.
- Carry out the Service, which includes:
- Managing your money transfers or requests (payments and collections);
- Processing any other request you make through the Service (e.g., revoking a payment or unsubscribing from Bizum or Bizum Pay); and
- Carrying out the portability process, if you decide to bring your Bizum to ABANCA from another bank or vice versa.
B. Enrollment of ABANCA cards in the Bizum Pay App.
- Data processing carried out by ABANCA. For the execution of payment orders using the cards in the App, ABANCA will process the following information:
- Identification and financial data: Information about the debit, credit, or prepaid cards you enroll in the App.
- Transaction data: Data about payment operations you carry out through the mobile device with the enrolled cards.
The purpose of processing this data will be the management, development, and control of the card contract you have with the Entity (including, therefore, payment operations made with the card). Thus, the data protection regime that will apply to you is detailed both in the card contract itself and in the Privacy Policy included in your ABANCA Client File, which is also published on our website.
- Data processing carried out by Bizum, S.L., the company that owns the Bizum Pay App. The service of enrolling and using cards issued by ABANCA in the Bizum Pay App also involves processing by Bizum, S.L., as the data controller, of the following information:
- Identification and financial data: Information about the debit, credit, or prepaid cards you enroll in the App.
- Transaction data: Data about payment operations you carry out through the mobile device with the enrolled cards.
If you wish to enroll the cards from your Mobile Banking, ABANCA will share the card tokens (the number or virtual code assigned to the card as a security measure) with Bizum, S.L.
The purpose of processing your data by Bizum, S.L. will be to integrate the card into the App and process the payment requests you make, considering that Bizum, S.L. is the owner of the App and also manages the payment and collection solution integrated into the Service.
The data protection regime applied by Bizum, S.L. is set out in its Privacy Policy, which you must accept when installing the App on your device. In this regard, you agree to carefully read the General Terms and Conditions for the use and download of the "Bizum Pay" App, as well as the Privacy Policy of Bizum, S.L., in order to understand the conditions of data processing by Bizum, S.L. ABANCA assumes no responsibility for the data processing carried out by Bizum, S.L.
2. Processing carried out to comply with legal obligations:
ABANCA is required by applicable regulations to provide the Beneficiary Verification Service ("VdB" or "VoP") for money transfers you order or of which you are the beneficiary. The VdB is regulated in your account and/or credit account contract with ABANCA and is a free service that allows the sender of a transfer within the Single Euro Payments Area (SEPA) to confirm in advance the identity of the money's beneficiary.
In the case of the Bizum Service, if you are the recipient of a money transfer that another user registered with Bizum through us wishes to make to you, ABANCA will show that user the alias you have in Bizum, so they can verify that you are the correct recipient of the money.
3. Processing based on ABANCA's legitimate interest:
Detecting and preventing fraud: It is in ABANCA's legitimate interest to prevent fraud in the use of our services (e.g., identity theft or password theft) that could result in harm to you, third parties, and/or ABANCA. Therefore, we will carry out the following processing of your personal data: if you register and use Bizum Pay, Bizum, S.L. will inform us which system you use to unlock your device and thus operate the App (e.g., if you use your fingerprint, a code, or facial recognition); it will also inform us if it detects any change in the unlocking method, as in such a case the App will be blocked as a security measure. In that case, you will have to reactivate the App's operation by accessing your ABANCA Mobile Banking to identify yourself again.
It is important for you to know that ABANCA will never have access to your biometric data (such as your fingerprint or your face), as these are managed by the device or operating system manufacturer as appropriate. Therefore, ABANCA will not be responsible for any damages that may result from misuse of biometric information or from a possible security breach in its use.
To whom do we disclose your personal data?
For the Service to function properly and to fulfill the purposes indicated in the section "Why do we process your personal data?", it is necessary for ABANCA to share your data with:
- Bizum, S.L., the entity that manages the payment and collection solution integrated into the Service, and which is also the owner of the Bizum Pay App.
- Financial entities (e.g., banks) affiliated with BIZUM, identified at this link: https://bizum.com/es/bancos/You will be redirected to another website.
- Other users of the Service to whom you wish to send money or request a payment:
- Individuals (friends, family, etc.).
- Professionals providing you with a service.
- Businesses where you purchase an item.
- NGOs (Non-Governmental Organizations) to which you wish to make a donation. In these cases, your NIF will be part of the information communicated to them along with the payment transaction.
- The State Lottery and Betting Company, if you wish to pay for lottery tickets or collect your winning bet through the Service.
- Users from other SEPA countries with services similar to Bizum (EuroPA functionality).
Of all the data indicated in the section "Where do your personal data come from and what data do we process?", we will only share those that are relevant for the proper functioning of the Service, depending on the action to be performed. For example:
- When you register for the Service, we will communicate to Bizum, S.L. your name, surname, ID, and mobile phone, as well as your account token (that is, the number or virtual code assigned to your account as a security measure), so that Bizum, S.L. can assign you an alias and start managing the payment and collection solution.
- Or when you wish to enroll a card in the Bizum Pay App from your Mobile Banking, we will share the card token (the number or virtual code assigned to your card as a security measure) with Bizum, S.L., so you can pay with it.
- Or when you want to send money to a user who is a client of another bank (other than ABANCA), we will communicate your payment order information to their bank.
How long do we keep your data?
As long as you maintain products or services with us and also afterwards, for 5 years (if you have given us your consent for this). Once your relationship with ABANCA ends or those 5 years have passed, your data will be blocked for the statutory limitation periods. After that, we will delete them.
What are your rights?
You may exercise the rights of access, rectification, erasure, objection, restriction of processing, and portability:
- With ABANCA, via postal address: Rúa Nueva, 1 - Entreplanta, 15003, A Coruña; or by email to: atencioncliente@abanca.com.
- With BIZUM, S.L., by writing to the company at its registered office (Calle Francisco Sancha 12, 28034 Madrid). Bizum also provides forms at https://www.bizum.es.
- With the financial entities affiliated with BIZUM, at the addresses they provide you.
Finally, you can file a complaint with the Spanish Data Protection Agency.
Will ABANCA's customer privacy policy also apply to you?
Yes. For any detail not included in this Clause, the Privacy Policy included in your Client File and also published on our website will apply.
